Welcome to HexaTransfer. These Terms of Service ("Terms") govern your use of the HexaTransfer file transfer service ("Service") operated by Gaprod (Groupe Dwenola SAS), a company registered in France, with its registered office at 231 rue Saint-Honoré, 75001 Paris, France ("Company", "we", "us", or "our").
By accessing or using HexaTransfer, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. DESCRIPTION OF THE SERVICE
HexaTransfer is a free, end-to-end encrypted file transfer service. Users can upload files, which are encrypted in the browser before transmission, and share download links with recipients. No account registration is required.
2. ACCEPTABLE USE
You agree to use HexaTransfer only for lawful purposes. You must not:
- Upload, share, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Transmit malware, viruses, or any other malicious code.
- Use the Service to infringe upon the intellectual property rights of others.
- Use the Service to send unsolicited communications (spam).
- Attempt to gain unauthorized access to the Service or its infrastructure.
- Use the Service in a manner that could damage, disable, or impair its operation.
3. FILE STORAGE AND EXPIRATION
Files uploaded to HexaTransfer are stored temporarily and are automatically deleted after the expiration period selected by the sender (up to 14 days). We do not guarantee the availability of files for the full expiration period. Files may be removed earlier in compliance with legal obligations or our internal policies.
4. END-TO-END ENCRYPTION
HexaTransfer uses client-side encryption. Files are encrypted in your browser before being uploaded to our servers. We do not have access to the encryption keys and cannot decrypt your files. You are solely responsible for securely sharing the download link and any passwords with intended recipients.
5. PRIVACY
Your use of the Service is also governed by our Privacy Policy. We collect minimal personal data and do not sell or share your information with third parties for marketing purposes.
6. INTELLECTUAL PROPERTY
The HexaTransfer name, logo, and all related trademarks, service marks, and logos are the property of Gaprod (Groupe Dwenola SAS). You may not use these marks without our prior written consent.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEXATRANSFER AND GAPROD (GROUPE DWENOLA SAS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.
8. INDEMNIFICATION
You agree to indemnify and hold harmless Gaprod (Groupe Dwenola SAS), its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
9. MODIFICATIONS TO THE TERMS
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the HexaTransfer website. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms.
10. TERMINATION
We may suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, the Company, or third parties.
11. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.
